Terms and Conditions

Availability
All wines are offered for sale subject to availability and subject to the seller’s acceptance of the purchaser’s order how so ever made. No order submitted by the purchaser shall be deemed accepted by the seller unless and until confirmed by the seller.

Price Match Commitment
At The Wine Explorer Limited we are pleased to offer a price match promise. If you can find identical wines at a lower price elsewhere in the UK, contact us and we will be happy to match the lower price. Please note that our price match promise includes wines at standard RRP and excludes any wines that might be discounted or included in special sales with other retailers and online stores.

Minimum Order
The minimum order is one case of 12 bottles which may be mixed.

Payment
Switch, Mastercard and Visa are accepted. If payment is made by credit card, there is a surcharge of 3%. Cheques should be made payable to The Wine Explorer Limited. In the event of any cheque that is returned ‘refer to drawer’ or ‘re-present’, the client will be charged £25 on each occasion. Payment can also be made directly into the company’s bank account via BACS or CHAPS: Details on request.

Delivery
The purchaser must carefully examine all goods as soon as they are delivered, noting any shortages or breakages and must clearly sign the delivery note to acknowledge receipt. We regret we cannot accept claims for shortages or breakages not recorded on the delivery note. In any case, claims must be made to The Wine Explorer Limited within three days of delivery. The Wine Explorer Limited has authorised its carriers to deliver only when a signature for receipt is obtainable. However where specific instructions are given to leave wine in a safe place without a signature being obtained, or to leave the consignment at an address other than that of the customer, The Wine Explorer Limited cannot accept responsibility for loss or damage as a result of carrying out those instructions. The Wine Explorer Limited is not responsible for loss or damage to goods while held at the purchaser’s premises. It is essential that all claims for damage, pilferage or breakages must be notified to the seller in writing within three working days of delivery. The Wine Explorer regrets that neither it, nor its carriers can accept responsibility for any subsequent loss or damage which occurs once the consignment has been delivered.

Title
Title in the goods is retained by The Wine Explorer Limited until full payment has been received.

Force Majeure
The Company will not be liable for failure to meet agreed obligations due to circumstances beyond its control.

Law
All contracts are governed by English law and jurisdiction.

Carriage Charge
Carriage Charge for UK Mainland, excluding Scotland, is £15.00 for 12-23 bottles. Delivery throughout most of mainland UK is free on orders of 24 bottles or more to one address. Worldwide deliveries; price on application.

Amendments to these Terms and Conditions
The Wine Explorer Limited may amend these Terms and Conditions on occasion. It is important that clients review these Terms and Conditions regularly as the client will be considered to have accepted a change after the changed terms have been published on the site.

Other
Customers must be 18 years of age or older. By placing an order customers confirm that they are over 18 years old.

Event Terms and Conditions

Event Payment Terms
A non-refundable deposit of 50% of the overall price of the booking must be paid within seven days of acceptance of the booking, a signed contract or invoice being proof of such acceptance. The balance of the overall price must be paid not less than 30 days before the date of the event. If the booking is made within 30 days of the event, the full amount must be paid immediately upon the booking being accepted. If payment is not made within the time limits stated above, this will be in breach of the contract by the client, entitling The Wine Explorer Limited to treat the contract as at an end, and re-allocate the corporate hospitality facilities without informing the client. In the event of The Wine Explorer Limited treating the contract as at an end, as stated above, The Wine Explorer Limited shall be entitled to retain all sums already paid by the client. The balance, if any, of the cost / price of the booking shall become immediately payable by the client to The Wine Explorer Limited. This is without prejudice to The Wine Explorer Limited’s rights to claim damages from the client in respect of any loss suffered by The Wine Explorer Limited. All prices quoted are exclusive of VAT. In the event of the rate of VAT applicable being increased between the acceptance of a booking and an event, the client should be liable to pay such increase before the event goes ahead. The Wine Explorer Limited have the right to change the price applicable to a booking (upwards or downwards) at any time prior to a booking being accepted.

Event Cancellation & Postponement
Any notice of a cancellation or postponement by the client of a booking, or part of a booking, must be made in writing, by letter, sent by recorded delivery to: The Wine Explorer, 75 Bartholomew Street, Newbury, Berkshire, RG14 5DU. If a booking, or part of a booking is cancelled or postponed by the client more than 30 days before the event, the client shall be liable for 50% of the total price of the booking. If a booking, or part of a booking is cancelled or postponed by the client less than 30 days before the event, the client shall be liable for the total price of the booking. If an event is cancelled or postponed for any reason, including national emergency, outbreak of war, prohibitive government regulations, strikes, consequences of terrorism, inclement weather conditions or any other cause beyond the reasonable control of The Wine Explorer Limited, no refunds will be made.
